\u003cp\u003e15时许，胡某酒后驾驶的小轿车突然越过道路中心线，逆向行驶，与对向的公交车发生猛烈碰撞。事故造成包括杨某在内的9人受伤，杨某经抢救无效不幸离世。\u003c/p\u003e \u003cp\u003e事故经交警部门认定，小车驾驶人胡某承担事故全部责任，公交车驾驶人欧某及车上乘客无责任。\u003c/p\u003e \u003cp\u003e承运人负有无过错的安全保障义务。根据《\u003c!--SECURE_LINK_BEGIN_0--\u003e中华人民共和国民法典\u003c!--SECURE_LINK_END_0--\u003e》第八百二十三条规定“承运人应当对运输过程中旅客的伤亡承担赔偿责任”。本案中，杨某与某运输公司之间成立了客运合同关系，某运输公司作为承运人，有义务将乘客安全送达目的地。乘客在运输途中因交通事故死亡，某运输公司依法应承担违约责任。即使事故是第三人胡某全责所致，某运输公司也需先向乘客家属赔偿，之后可向侵权人胡某追偿。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e
